What types of online games are legal?

Online casinos

Horse Racing

An increasing number of states now feature advance deposit wagering mobile horse racing apps and racebooks, including from US sports betting leaders such as DraftKings and Caesars. Unlike sportsbooks, these racebook apps can determine betting eligibility based on a bettor’s state residence, not their physical location at the time of the bet.


Forty-five states now have a government-run lottery and many of those jurisdictions are expanding these options online. Either directly through the state website or third-party providers, a growing number of Americans have access to major providers such as Powerball and Mega Millions.

Daily Fantasy Sports

America’s two largest daily fantasy sports operators, DraftKings and FanDuel, have successfully argued that these offerings are not gambling, allowing them to expand to most US states. First operating in a legal grey market, and now legally allowed to serve millions of players either explicitly through legislation or court decisions, DFS sites are seemingly ubiquitous in the US.

  • While WV Rep. Jason Barrett submitted HB2934 (the bill that served base for the state’s Interactive Wagering Act) in February 2019, it didn’t come into effect until June 2019.  

  • The Mountain State’s first online casino launched in July 2020, with the DraftKings Casino app going live.  

Connecticut Casino Gambling
  • Gov. Ned Lamont signed HB6451 into law in May 2021, legalizing online casinos in Connecticut. 

  • Currently, only DraftKings Casino and Mohegan Sun online casino are live in the Constitution State.  

  • Since Connecticut’s gambling bill was developed alongside a state-tribal gaming compact, only the state’s two Tribes are allowed to conduct legal online wagering on tribal land.

Rhode Island

  • The state gaming market will be a de facto monopoly run by Bally’s, which also runs the state’s two commercial casinos; Bally Bet will be the only legal online platform

  • The Ocean State will be the first regulated iGaming market to require all table game offerings to feature live dealers; players will not be able to access dealerless digital blackjack or other similar games.

  • Delaware was one of the first states to take legal online sports bets as well as offer a regulated iGaming platform

  • Though there are technically three different iGaming platforms, all three are run by the state lottery; Rush Street Interactive is set to take over operations from European provider 888 in the second half of 2023

November 2023: Fanatics launches first online casino

Fanatics has launched its eponymous online casino platform in West Virginia, becoming the latest company to offer iGaming in a regulated market.

The West Virginia iGaming launch is the first for the sports merchandise dealer-turned-digital gaming operator. The Fanatics iCasino will be embedded in the company’s digital sportsbook, according to a release announcing the launch.

West Virginia is one of four states with a competitive legal iGaming market, along with Michigan, New Jersey and Pennsylvania. It’s not clear when or if Fanatics plans to launch its iGaming platform in these additional states. Fanatics mobile sportsbook is also live in Kentucky, Maryland, Massachusetts, Ohio, and Tennessee.

The Fanatics iCasino will feature slots, roulette and blackjack, including an exclusive blackjack offering. More games and features are coming in the “near future,” per the release.

Fanatics acquired PointsBet in August 2023 and has migrated customers onto the new platform. PointsBet registrants can use their same login information to access Fanatics.

October 2023: Newest US online casino market set for 2024 launch

Rhode Island, the seventh state to legalize online casino gaming, has still not launched its lone regulated real money iGaming platform.

State lawmakers approved an extension of the state’s online sports betting monopoly in the summer of 2023, permitting real money gaming in addition to the existing Sportsbook Rhode Island sports betting offerings. Run via the state lottery’s exclusive deal with Bally’s, the platform will permit digital slots, blackjack, roulette, and other classic casino games.

The bill goes into effect on March 1, 2024, meaning Rhode Island iGaming could begin as early as that day. The Sportsbook Rhode Island site has no mention of online casino gaming as of fall 2023. The Bally Bet online casino page only shows links to New Jersey and Pennsylvania.

Once live, Rhode Island will follow the pair of Northeastern states, as well as Michigan, Connecticut, West Virginia, and Delaware among states with regulated real-money online casino gaming. Rhode Island joins Delaware among jurisdictions with de facto monopolies.

Nevada allows legal real-money online poker sites but no slots or table games.

Lawmakers in Illinois, Iowa, Indiana, New York, and potentially several other states are set to consider iGaming legalization as early as next year. While sports betting has expanded to more than 30 states, online casino gaming legalization has stalled in most jurisdictions over fears of gaming revenue cannibalization and exacerbated problem gambling.
